    I believe that § 1291.15 Agreements - (a)(4)(ii)(B) Noncompliance by a project sponsor or project owner — Recovery of AHP subsidies may contain extraneous language which lends to confusion.

    § 1291.15 (a)(4) refers to the Repayment of AHP subsidies in case of noncompliance where paragraph (i) outlines "Noncompliance by the member" and (ii) outlines "Noncompliance by a project sponsor or project owner". Therefore, I believe the inclusion of the "Noncompliance by the member" in paragraph (ii)(b) in the section related to project sponsor or owner is inapplicable.

    If my postulation about the phrase being inapplicable is inaccurate, please explain the intent.
